How Health Insurance Agents Can Comply with New CMS Rules Using Quotit's EDE

As a health insurance agent that sells ACA plans, staying updated with regulatory changes is critical to your success and your clients' satisfaction. The latest announcement from the Centers for Medicare & Medicaid Services (CMS) is a pivotal update for those involved in the Federally Facilitated Marketplace (FFM)

Effective July 19, 2024, new measures have been implemented to halt unauthorized agent and broker marketplace activities. This blog will explore the implications of these changes, the required actions for compliance, and how partnering with Quotit’s Enhanced Direct Enrollment (EDE) platform can simplify the process.

What You Need to Know

On July 19, 2024, CMS rolled out a significant update aimed at curbing unauthorized activities by agents and brokers within the ACA marketplace. This directive requires agents not already associated with a consumer's enrollment to undertake one of the following steps:

  1. Conduct a Three-Way Call: The agent, consumer, and the Marketplace Call Center must engage in a three-way call. This process ensures that any modifications to the consumer's enrollment are verified and approved in real-time.

  2. Direct Consumer Submissions: Consumers can be directed to submit changes directly through HealthCare.gov. This method provides a straightforward path for consumers to manage their own enrollments.

  3. Utilize Approved EDE Partner Websites: Agents can use an approved Classic Direct Enrollment or Enhanced Direct Enrollment partner website, like Quotit, to facilitate consumer changes through a secure, verified pathway.

These changes are designed to enhance transparency and security within the marketplace, ensuring that only authorized agents and brokers handle consumer enrollments. The new rules also protect consumers from unauthorized changes and potentially fraudulent activities.

What Prompted the Change?

In the first half of 2024, CMS received an alarming number of over 70,000 consumer complaints regarding unauthorized changes to their plans, along with over 130,000 complaints of consumers being enrolled in plans without their consent. Prior to the implementation of the new regulations, agents had the ability to finalize enrollments without obtaining proof of consumer consent, and various enrollment platforms permitted agents and brokers to switch the agent of record on existing applications without consumer consent.

The recent changes from CMS highlight a strong focus on protecting consumers and maintaining the integrity of the FFM. For health insurance agents selling ACA plans, this means following stricter protocols and using approved tools and systems, like Quotit, to stay compliant. These actions not only prevent unauthorized activities but also help build trust with clients, ensuring they feel secure in their information and decisions.

What This Means for Agents

If you are not currently listed as the Agent of Record on a consumer's enrollment, you will need to follow one of the three authorized steps to finalize the enrollment. Failing to complete these steps could lead to potential suspension due to concerns of fraud or misconduct related to unauthorized enrollments or plan changes. Suspended agents and brokers are not permitted to continue enrolling clients through the Marketplace or receive commissions. To maintain compliance and avoid suspension, agents must adhere to one of the following:

1. Conduct a Three-Way Call: Agents have expressed concerns about the time required for this call, estimating it to take around 25-30 minutes. They worry that this added task may impact their bottom line and are also wary of potential increases in wait times during the upcoming Open Enrollment Period.

2. Direct Consumer Submissions: Agents can guide consumers to Healthcare.gov to manage changes independently. It is important for agents to assist each consumer in ensuring that the agent's accurate identifying information (name and NPN) is included during the Marketplace enrollment process to ensure the agent receives appropriate credit and compensation.

3. Utilize Approved EDE Partner Websites: This pathway enables CMS to collaborate with the private sector in delivering a more user-friendly and seamless enrollment experience. It's important to note that not all EDE Partner Websites are the same. Agents should seek out a dependable EDE partner to minimize any potential frustrations and avoid unnecessary time-consuming tasks in case of faulty EDE links.
